With this reform, there are now only 5 European Union member states which are yet to prohibit all corporal punishment of children: Belgium, the Czech Republic, Italy, Slovakia and the United Kingdom. Previous statements issued by the Global Initiative raised concerns that the term 'corporal punishment' originally included within article 1 of the Bill was removed before its adoption in the National Assembly.

However, the Global Initiative is satisfied that the intention of the law as adopted is to prohibit all forms of corporal punishment of children:. Some concerns have been raised about the 'right of correction' in jurisprudence judicial decisions which has not been explicitly repealed in the Law.


It was highlighted during the debates that, since the 'right of correction' does not have a basis in legislation, it was inappropriate to repeal it in legislation. In the French civil legal system, the law is higher in the hierarchy of norms than judicial decisions; meaning that this prohibition in the Civil Code should prevent judges from upholding the 'right of correction'.

We will continue to monitor decisions to ensure this is applied in practice.
